Community Title has several advantages over the alternatives.  Community title is preferred because –

  • Community title is purpose designed by parliament to provide a system for administering land.
  • Community title obligations run with the land. Other systems are flawed and often unsuccessful because the obligations attach to individuals, who may not be the owner or the resident of the land. When obligations run with the land then residents and the owners are not free to opt in and opt out of compliance with the governance. While the governance is mandatory, participation is still voluntary for the individual. i.e. Individuals are not forced to attend meetings and be part of the dialogue and decision making process.
  • Other systems are patched together from legal structures designed for  other things. All of these hybrids are cumbersome to document, merge operationally and generally contain defects in their application to land.
  • Community title has a system of precedent and a history.
  • Community title is increasingly widespread in Australia and internationally.   The population accepts the governance methodology with Community title becoming increasingly understood. There are education opportunities (like TAFE courses) for those who wish to participate.

Community title has a proven mechanism for the collection of money from the members
