Committee member nominations and ballots
Hi Vanessa,
We are in an accommodation module scheme in QLD with 60 lots, with end of financial year on 31 Dec, and the AGM at the end of March. The BC Manager recevied written committee nomination forms before 31 Dec as follows:
· 1 x for Chairman
· 1 x for Treasurer
· 1 x for Secretary
· 1 x for Ordinary member
Does this mean at the AGM that all 4 of the above are elected unopposed, and that nominations are welcomed from the floor for only the 3 remaining Ordinary members? And if, say, 4 or 5 or 6 Ordinary position nominations were received from the floor, then the vote would be between them only (ie, the 4 or 5 or 6 nominations received from the floor - so the 3 with the highest votes win, and they are elected to the 3 remaining ordinary positions)? Or is the Ordinary member who sent in their written nomination before 31 Dec also up for election along with the ones from the floor?
I have read sections 17 - 27 of the Module again and again, and it is far from clear!!

Hi,
Well all the nominations recieved before the expiry date (31st December 2011) are now members - so long as they are financial. They cannot be opposed unless they owe money or are not Owners or family members (as per BCCM). Now that leaves only 3 positions left for Committee members if all is well with the top 4. These positions now can be called from the floor. If more than 3 Owners wish to be on the committee as normal members then a vote must be held. That can happen a number of ways. Paper vote, show of hands. It all depends on what the Body Corporate is like (a friendly bunch). Your Community Manager should have a number of little voting papers just in case,,all good managers do. A committee must consist of at least 3 members and the total limit is 7 - but you new that. :D
