Shane is the Partner in charge of our Commercial Dispute Resolution practice group at Holman Webb Lawyers Brisbane. Shane has 20 years litigation experience, having completed 5 years of Articles of Clerkship before being admitted as a solicitor in 1992. Shane has been involved in litigation in the Federal, Queensland Supreme and District Courts and regularly participates in Alternative Dispute Resolution procedures including mediation, case appraisal and arbitration.
Relevant Experience
- Both prosecuting and defending commercial disputes involving claims relating to the Trade Practices Act, negligence and contract.
- Enforcing judgments and settlements through all avenues including bankruptcy, winding up, enforcement warrants, monitoring instalment arrangements, lodgement of caveats and the like.
- Preparing and advising on complex building and construction contracts and consultancy agreements.
- Defending prosecutions brought by ASIC for breaches of various provisions of the Corporations Act including ss180-183 with respect to breaches of Director’s duties.
- Advising clients and representing them with respect to ASIC investigations including advising clients on the scope of ASIC’s powers of investigation under, for example, s19 of the ASIC Act regarding compulsory examinations under oath.
- Acting for clients with respect to proceedings brought by and against the Building Services Authority (BSA) with respect to, for example, the removal of building licences from clients and the prosecution of clients for breaches of provisions of the Queensland Building Services Authority Act.
- Advice to Directors and company officers with respect to the Director’s duties both at common law and under the Corporations Act.
- Advice to Directors and company officers with respect to the potential protection afforded to them by the Business Judgment Rule.
